Fandango’s The Dark Knight Sweepstakes - Official Rules

1. ELIGIBILITY: Fandango’s The Dark Knight Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia (excluding Puerto Rico, all U.S. Territories and Possessions and all Overseas Military Installations) eighteen (18) years of age or older as of June 30, 2008, with access to the Internet at all times during the Sweepstakes Period (as defined below) and subsequent prize-award period (as defined below). All employees of Fandango, Inc. (“Sponsor”), all employees of Warner Bros. Entertainment Inc., AsiaLuxe Holidays and all associated agencies and each of their respective affiliates, sales representatives, distributors, licensees or agents (all of the foregoing, together with Sponsor, collectively referred to as “Sweepstakes Entities”), and their immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in the same household of each (whether legally related or not), are ineligible to enter or win the Sweepstakes. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Entry in the Sweepstakes constitutes your full and unconditional acceptance of these Official Rules. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

2. SWEEPSTAKES PERIOD: The Sweepstakes entry period begins as of 5:01 p.m. Pacific Daylight Time ("PDT") on June 30, 2008 and ends as of 5:00 p.m. PDT on July 28, 2008 (the "Sweepstakes Period"). Winners will be selected from entries properly submitted and received during the Sweepstakes Period.

3. SWEEPSTAKES ENTRY INSTRUCTIONS:  During the Sweepstakes Period, you may submit an entry online at www.fandango.com/summermovies (“Online Entry”). Enter your name and e-mail address, and click “Submit.” Limit 1 (one) Online Entry per person, per e-mail address, and per household during the Sweepstakes Period, via Online Entry. Entrants will have the opportunity to receive up to three (3) additional entries by signing-up for one (1) or more of the following free services: 1.) Sign up to receive Fandango movie news and/or 2.) Sign up to receive text messages from Fandango on your mobile device and/or 3.) Sign up to receive updates from AsiaLuxe Holidays.

4. ALTERNATIVE MEANS OF ENTRY:  You may also enter the Sweepstakes by mailing a standard-size postcard with your name and e-mail address to: Fandango’s Dark Knight Sweepstakes Entries, c/o Fandango, Inc., 12200 W. Olympic Boulevard, Suite 150, Los Angeles, CA 90064. Postcard entries must be received during the Sweepstakes Period to be included within the random drawing, Entrants will have the opportunity to receive no more than (3) additional entries by submitting one (1) additional postcard for each additional entry during the Sweepstakes Period.

5. PUBLICITY: As a condition of entry into the Sweepstakes, except where prohibited by law, each entrant and each potential Grand Prize Winner by accepting a prize grants to Sponsor and Sponsor's affiliates, legal representatives, assigns and licensees, all right, title and interest in to publicize, broadcast, display and/or otherwise use the Sweepstakes entrant’s name, city, state, and biographical material (collectively, “Licensed Rights”) in any media now known or hereafter devised throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission or approval of the Grand Prize Winner.

6. SELECTION OF SWEEPSTAKES WINNERS/ODDS: The potential Grand Prize Winner will be selected in a random drawing to be held on or about August 4, 2008. The potential Grand Prize Winner will be selected from all eligible entries received during the Sweepstakes Period. Odds of winning will depend on the number of eligible entries received during the Sweepstakes Period. The potential Grand Prize Winner will be notified via e-mail to the e-mail address submitted with his/her entry within two (2) weeks after the drawing ("Prize Award Period"). The drawing will be conducted by Sponsor, the judge of the Sweepstakes, whose decisions on all matters relating to the Sweepstakes shall be final and binding. In the event that a potential Grand Prize Winner is disqualified for any reason, Sponsor may, in Sponsor's sole discretion, award the applicable Grand Prize to an alternate potential Grand Prize Winner selected at random. If an entrant’s name is selected more than once, an alternate potential Grand Prize Winner will be randomly selected. Any return of Grand Prize notification or prize e-mail as undeliverable will result in forfeiture of any Grand Prize and an alternate potential Grand Prize Winner may, at Sponsor's discretion, be randomly selected. The potential Grand Prize Winner will be required to execute and return an Affidavit of Eligibility/Liability and Publicity Release within ten (10) business days of attempted notification or the potential Grand Prize Winner may be disqualified and an alternate potential Grand Prize Winner selected.

7. PRIZES:  One (1) Grand Prize with a total Approximate Retail Value ("ARV") of Four Thousand Nine Hundred Ninety-Nine Dollars ($4,999.00) (USD) to include: A five (5) day/ four (4) night tour package, “Hong Kong Wonders”, courtesy of AsiaLuxe Holidays; round-trip airfare for two (2) passengers on Cathay Pacific Airlines between Los Angeles and Hong Kong (ARV:$3,000 (USD)); four (4) nights' lodging at Kowloon Shangri-la Hotel including breakfast. (ARV: $1,499 (USD)). Additional Grand Prize award details and travel information to be provided to the Grand Prize Winner at the time of Grand Prize notification. Grand Prize will not be replaced if lost or stolen and is nontransferable. Grand Prize is not redeemable for cash and no substitutions are allowed. The Grand Prize will be delivered only to addresses in the United States. All taxes are responsibility of the Grand Prize winner. An IRS Form 1099 will be issued in the name of Grand Prize Winner for the actual value of the Prize received.

All expenses not specifically mentioned herein, are not included as part of any Grand Prize package, and are solely the Grand Prize Winner’s responsibility, including but not limited to: hotel taxes, round trip transportation between the Grand Prize Winner’s residence and Los Angeles airport of origin, additional ground transportation at the Grand Prize Winner’s destination(s), travel insurance, room service, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Airline carrier and hotel regulations and conditions apply. Travel and lodging are subject to availability, and any changes made to either of these will be at the expense of the Winner, certain restrictions, blackout dates may apply. Airfare may not include government taxes, Passenger Facility Charge or September 11th Security Fee. Passport and Visa-related expenses are not included. Grand Prize Winner and guest(s) must travel together on the same itinerary and be responsible for obtaining all required travel documents. Winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance; winner and guest(s) will be required to execute and return a Release of Liability form, which shall include all prize and travel-related details. A guest may not be a minor unless the Grand Prize Winner is his/her parent/legal guardian. ARV of prize may vary depending on point of departure, travel dates and fare/rate fluctuations. Sponsor's failure to enforce any term of these rules shall not constitute a waiver of that provision; you further agree that in any cause of action, the Sweepstakes Entities’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Entities be liable for attorneys' fees and/or experts' fees and costs. By participating in the Sweepstakes, you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

8. GENERAL RULES: By entering or participating in the Sweepstakes, participants agree to be bound by these Official Rules, and by the decisions of Sponsor, which are final and binding in all respects. Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind, (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of entries, or the selection or notification of winners. Further, if, for any reason, the Sweepstakes is not capable of running as planned for reasons outside the control of the Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or portion thereof), Sponsor reserves the right, at Sponsor's sole discretion, to cancel, terminate, modify or suspend the Sweepstakes (or portion thereof). Sponsor also reserves the right at Sponsor's sole discretion to disqualify the Entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any website operated by the Sweepstakes Entities; (b) using any robotic, macro, automatic, programmed or like entry methods, which will void all such entries; (c) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Sweepstakes Entities are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the prize; participation in this Sweepstakes or in any activity or travel related thereto or from any interaction with, or downloading of, computer Sweepstakes information. Sweepstakes Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished in connection with this Sweepstakes.

9. PARTICIPANT OBLIGATIONS: By participating in the Sweepstakes, you agree to be bound by these Official Rules and the decisions of Sponsor. By accepting the prize, the Grand Prize Winner agrees to release and hold harmless Sweepstakes Entities from and against any and all losses, damages, rights, claims, actions and liabilities of any kind in connection with the Sweepstakes or receipt or redemption of the prize. The Grand Prize Winner assumes all liability for any injury, death, or damage caused, or allegedly caused, by participating in the Sweepstakes or use or redemption of the prize. Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of California without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the State of California.

10. PERSONAL INFORMATION: The personal information collected through the Sweepstakes is subject to Fandango’s Privacy Policy, located at www.fandango.com/PrivacyPolicy.aspx. By entering the Sweepstakes, you agree to the use of your personal information as described in the above Privacy Policy.

11. RULES/WINNERS' LIST REQUESTS: To obtain a copy of these Official Rules or for notification of the winner, send a self-addressed stamped envelope to: Fandango’s The Dark Knight Sweepstakes Official Rules/Winner List Request, 12200 W. Olympic Boulevard, Suite 150, Los Angeles, CA 90064. Requests for winners' lists must be received no later than three months after the end of the Sweepstakes Period. VT residents may omit return postage.
